Senior Newsletter on Probate and Estate Planning

Here are some recent developments that have occurred in the areas of probate practice and guardianship administration specific to Lake County, Ohio:

PROBATE COURT UPDATES:

Lake County Local Rules were recently amended to incorporate the following changes:

          1.  Operating Hours - The Probate Court is open to the public Monday-Friday, 8am-4:30pm
        2.  Appraisals - Personal Property appraisals are no longer required.  This means that the clause in the Last Will
and Testament with language that waives the appraisal is no longer necessary.  Real Property appraisals are
no longer required.  The auditor's value will be used unless the heir objecting to that valuation obtains and pays
for the appraiser's service.  This is a distinct departure from prior practice and will ease the administration of
              the probate estate.
         3.  Guardianship and Probate Estate Administration - Receipts are now required for every expenditure made on
behalf of the Estate.  This is an important item to be aware of ahead of time so that you know to keep a proof
of each expenditure made on behalf of the estate.  (Prior practice permitted the heirs to review the accounting
and sign off on it without the need to attach receipts.)
